What
is the role of Buma Stemra
In order to use someones work, permission from the artist is needed.
When the permission is given, then the artist can ask a fee for the
publication or the recording of his work.
It will become clear to you that it is almost unfeasible for an author
to control where and when his work is used. For this reason musicians have
set up organisations do this for them, the Buma Union and the Stemra
Foundation, known simply as Buma/Stemra. For practical reasons, these
organisations have formed one company, established in Amstelveen. At
Buma/Stemra around 11,000 composers, songwriters and music publishers are
subscribed. Buma and Stemra dont limit themselves only to those who are
directly subscribed with them. Via contracts with authors rights
organisations abroad, Buma and Stemra represent millions of pieces of
music writtten by hundreds of thousands of composers and songwriters. The
chance that a certain piece of music is not managed by Buma/Stemra world
music repertoire is, therefore, very small.
Buma Union
Buma is engaged with the organising of permission and collecting of
fees for the public performances of pieces of music. This means concerts,
broadcasts on radio and television, background music in the hospitality
industry, shops and companies but also the presentation of a film with
music in the cinema, at a convention, or inside the company the film is
produced by. Permission from Buma is not needed for the performance of a
piece of music in the home.
Stemra Foundation
Stemra takes care of permission for the recording of music on CD, audio
cassette, Cdi, CD-ROM, and soundtracks for films and commercials for
composers, songwriters, and musicians who are members. Stemra gives record
companies, broadcasting networks, advertising agencies, film producers, et
al. permission to record and duplicate music for their productions on
behalf of the author.
A producer of commercials, feature films, educational or company
productions who wanted to use music in his production, for example, would
in most cases get it from Stemra. As representative of the world music
repertoire, Stemra can, in many cases, lend permission directly for the
chosen piece of music to be recorded for the project in question.
Concerning other forms of music permissions; for example, films for
television and cinema and commericials, Stemra must apply to the holder of
the rights to the music for permission. The request procedure and fees to
be paid are dependant on the type of proposal. You can read more about
